These Terms of Service ("Terms") form a legal agreement between you ("Customer", "you") and Vyas Mukkati, ABN 72 686 748 054, trading as CallCover ("CallCover", "we", "us"). By signing up for or using the CallCover service, you agree to these Terms.
If you don't agree, don't use the service.
1. The service
CallCover provides an AI-powered receptionist service that answers your business phone calls when you can't, captures the job details, and notifies you. The service includes:
- Maya (the AI receptionist)
- An Australian phone number you forward unanswered calls to (or use as your business number on the Pro tier)
- SMS notifications to your nominated mobile when a job is captured
- Call recordings and transcripts
- Booking calendar integration
- Other features specified in your selected plan (Standard or Pro)
We may add, remove, or change features. We'll give you reasonable notice for material changes.
2. Eligibility
To use CallCover you must:
- Be at least 18 years old
- Operate a registered Australian business (we'll ask for your ABN)
- Provide accurate signup information
- Not be a competitor evaluating us for purposes other than genuine commercial use
3. Subscription, billing, and fees
3.1 Plans
We offer two plans, with current pricing on callcover.tech:
- Standard — entry-level package with the core service
- Pro — adds custom voice, multi-line, increased call volumes, and additional services (ad creatives, website, strategy call, review SMS, priority support)
3.2 Billing
- Subscriptions are billed monthly in advance
- Setup fees are billed once at signup
- All amounts are in Australian Dollars (AUD), exclusive of GST unless stated
- We charge via your nominated payment method on the same day each month
- Failed payments may result in service suspension after 7 days
3.3 Price changes
We may change pricing for new subscription periods. We'll give you at least 30 days' notice before the change applies to your account. If you don't agree to the new price, you can cancel before it takes effect.
4. Money-back guarantee
We offer a 30-day money-back guarantee: if Maya doesn't capture at least three jobs for you in your first month of service, contact us within 30 days of activation and we'll refund your first month's subscription fee in full.
The guarantee applies once per account and only to the first paid month. Setup fees are also refundable within this window.
5. Your obligations
You agree to:
- Use the service for lawful business purposes only
- Comply with all Australian laws and regulations applicable to your business
- Inform your callers (where required by law) that calls may be recorded — by displaying a notice on your website, in your phone greeting, or another reasonable means
- Keep your account credentials secure
- Pay your subscription on time
You must not:
- Use Maya to make outbound calls without our written agreement
- Use Maya for harassment, scams, fraud, or any illegal activity
- Resell the service without our written agreement
- Reverse engineer, copy, or attempt to clone Maya
- Provide false information to Maya or our staff
We reserve the right to suspend or terminate accounts that violate these obligations.
6. Customer data and ownership
6.1 Your data is yours
All call recordings, transcripts, lead records, and customer information processed by Maya on your behalf belong to you. We act as a data processor on your behalf — see our Privacy Policy for details.
6.2 Data export and deletion
On request, we'll provide an export of your data in a standard format within 14 days. On account closure, we'll retain your data for 30 days (in case you reactivate), then permanently delete it. Audio recordings are deleted at 90 days regardless.
6.3 Aggregated insights
We may use anonymised, aggregated data (e.g., total calls handled per industry) to improve the service and for marketing. This will never be linked to your business or to specific callers.
7. CallCover's intellectual property
The CallCover service, software, branding, AI models, prompts, and underlying technology are owned by us or our licensors. We grant you a non-exclusive, non-transferable, revocable licence to use the service while your subscription is active.
We retain all rights not expressly granted.
8. Confidentiality
Each party agrees to keep the other's confidential information secure and not to share it without consent, except as required by law. This survives termination.
9. Privacy
We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms.
10. Service availability
We aim for 99% uptime but don't guarantee uninterrupted service. We may need to perform maintenance or updates. Where possible, we'll notify you in advance.
If our service is unavailable for more than 24 consecutive hours in a billing month, you can request a pro-rata credit for that downtime.
11. Warranties and disclaimers
To the maximum extent permitted by law:
- The service is provided "as is" without express warranties beyond those required by Australian Consumer Law
- We don't warrant that Maya will capture every call, will never make a mistake, or will be perfectly suited to every business
- We're not responsible for actions taken by your callers, third parties, or you in response to information captured by Maya
Australian Consumer Law: Nothing in these Terms excludes or limits any consumer guarantees that cannot be excluded under the Australian Consumer Law. Where our liability cannot be excluded, it is limited to (at our choice): re-supplying the service, or refunding the amount paid.
12. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or related to these Terms or the service is limited to the fees you paid us in the 12 months preceding the claim.
We're not liable for:
- Indirect, incidental, consequential, or special damages
- Lost profits, lost business opportunities, or loss of goodwill
- Damages arising from your callers' actions
- Damages arising from your or your customers' use of information captured by Maya
Nothing in this section limits liability that cannot be limited under Australian law.
13. Indemnity
You indemnify us against any claim, loss, or damage arising from:
- Your breach of these Terms
- Your unlawful or negligent use of the service
- Your failure to comply with applicable laws (including consent and privacy laws regarding call recording)
- Information you provide to us being inaccurate or misleading
This survives termination.
14. Termination
14.1 By you
You can cancel anytime via our Contact page or your account dashboard (when available). Cancellation takes effect at the end of your current billing period — there are no early termination fees.
14.2 By us
We may suspend or terminate your account if:
- You materially breach these Terms (with 14 days' notice to remedy, where reasonable)
- Your payment fails for more than 7 days after notice
- We're legally required to
- We discontinue the service entirely (with 60 days' notice and a pro-rata refund)
14.3 Effect of termination
On termination, your access to the service ends. We'll retain your data per Section 6.2.
15. Changes to these Terms
We may update these Terms as our service evolves. For material changes, we'll email account holders at least 30 days before the change takes effect. Continued use of the service after that date constitutes acceptance.
16. General
- Governing law: these Terms are governed by the laws of New South Wales, Australia.
- Jurisdiction: any disputes will be heard in the courts of New South Wales.
- Entire agreement: these Terms (together with the Privacy Policy and any plan-specific terms) form the entire agreement between us.
- Severability: if any part of these Terms is unenforceable, the rest remains in effect.
- Assignment: you cannot assign your rights without our consent. We may assign ours to a successor business.
- No waiver: if we don't enforce a right immediately, it doesn't mean we've waived it.
